5.1 Order Placement
When you place an order through our Site, you represent that the information you provide is accurate and that you are authorized to use the selected payment method. All orders are subject to availability and our acceptance. We reserve the right to refuse or cancel any order for any reason, including but not limited to product unavailability, errors in pricing or product descriptions, or suspected fraud.
5.2 Pricing and Taxes
All prices displayed on the Site are listed in United States Dollars (USD) and are subject to change without notice. Prices do not include applicable sales taxes, delivery fees, or service charges, which will be calculated and displayed at checkout. 5.4 Refunds and Cancellations
Once an order has been submitted and confirmed, cancellations may not be possible if food preparation has already begun. We are committed to customer satisfaction and will make reasonable efforts to resolve legitimate complaints in a timely manner.
5.5 Promotional Codes and Discounts

6. Delivery and Pickup
Delivery services are available within specific geographic areas at our discretion. Delivery times are estimates only and are not guaranteed. Factors outside our control, including but not limited to traffic, weather conditions, or high order volumes, may affect delivery times. Dewey's Pizza shall not be liable for any delays in delivery.
For pickup orders, you are responsible for picking up your order within the designated timeframe communicated at the time of order confirmation. Dewey's Pizza is not responsible for the quality of food that deteriorates due to delays in pickup.
Risk of loss or damage to your order passes to you upon delivery to the address you provide or upon your pickup of the order at our location.
7. Intellectual Property Rights
All content available on or through the Site, including but not limited to text, graphics, logos, icons, images, audio clips, video, digital downloads, data compilations, and software, is the exclusive property of Dewey's Pizza or its content suppliers and is protected by applicable United States and international intellectual property laws, including copyright, trademark, patent, and trade secret laws.
The Dewey's Pizza name, logo, and all related product and service names, design marks, and slogans are trademarks or service marks of Dewey's Pizza. You may not use any of our trademarks, service marks, or trade names without our prior written consent. Nothing in these Terms grants you any right or license to use any trademark, service mark, logo, or trade name of Dewey's Pizza.
You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Site for your personal, non-commercial use only. This license does not include:
- Any resale or commercial use of the Site or its contents;
- Any collection and use of product listings, descriptions, or prices;
- Any derivative use of the Site or its contents;
- Any downloading or copying of account information for the benefit of another merchant or business entity;
- Any use of data mining, robots, or similar data gathering and extraction tools.
Unauthorized use of our intellectual property may result in civil and/or criminal liability under applicable United States law, including the Digital Millennium Copyright Act (DMCA), 17 U.S.C. § 512, and other applicable statutes.
8. User-Submitted Content
If you submit reviews, comments, feedback, photographs, or other content ("User Content") to our Site or social media channels associated with Dewey's Pizza, you grant us a non-exclusive, royalty-free, perpetual, irrevocable, and fully sublicensable right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such User Content worldwide in any media.
You represent and warrant that you own or otherwise control all rights to the User Content you submit, that the content is accurate, and that its use does not violate any applicable law or these Terms. Dewey's Pizza reserves the right to remove or refuse to post any User Content at its sole discretion.
9. Disclaimer of Warranties
THE SITE AND ALL SERVICES, CONTENT, INFORMATION, PRODUCTS, AND MATERIALS PROVIDED THROUGH THE SITE ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT ANY WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND TITLE.
Dewey's Pizza does not warrant that:
- The Site will be uninterrupted, timely, secure, or error-free;
- The results obtained from the use of the Site will be accurate or reliable;
- The quality of any products, services, information, or other material obtained through the Site will meet your expectations;
- Any errors in the Site will be corrected.
Menu item descriptions, images, and nutritional information are provided for general informational purposes only and may not perfectly represent the actual product. Product images are for illustration purposes and may vary from actual items. Customers with food allergies or dietary restrictions are advised to contact us directly before placing an order, as we cannot guarantee that any menu item is free from allergens.
Some jurisdictions do not allow the exclusion of implied warranties, so some of the above exclusions may not apply to you. In such cases, implied warranties are limited to the greatest extent permitted by applicable law.
10. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, DEWEY'S PIZZA, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, LICENSORS, SUPPLIERS, AND SERVICE PROVIDERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, REVENUE, DATA, GOODWILL, BUSINESS INTERRUPTION, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO YOUR USE OF OR INABILITY TO USE THE SITE OR SERVICES, EVEN IF DEWEY'S PIZZA HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
IN NO EVENT SHALL THE TOTAL AGGREGATE LIABILITY OF DEWEY'S PIZZA TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF OUR SITE AND SERVICES EXCEED THE GREATER OF: (A) THE TOTAL AMOUNT YOU PAID TO DEWEY'S PIZZA IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM; OR (B) ONE HUNDRED UNITED STATES DOLLARS ($100.00).
The limitations of liability set forth in this section shall apply regardless of the legal theory on which the claim is based, whether contract, tort (including negligence), statute, or any other legal or equitable theory, even if such remedy is found to have failed of its essential purpose.
Some states, including New Jersey and Massachusetts, do not allow the limitation of certain types of damages. If you reside in such a state, some or all of the above limitations may not apply to you.
11. Indemnification
You agree to defend, indemnify, and hold harmless Dewey's Pizza and its respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any and all claims, liabilities, damages, judgments, awards, losses, costs, expenses, and fees (including reasonable attorneys' fees) arising out of or relating to:
- Your violation of these Terms of Service;
- Your use of the Site or services in an unauthorized or unlawful manner;
- Your violation of any applicable federal, state, or local law or regulation;
- Your infringement of any intellectual property or other rights of any third party;
- Any User Content you submit to the Site;
- Your negligence, willful misconduct, or fraudulent activity;
- Any dispute or claim arising from your interaction with other users of the Site.
Dewey's Pizza reserves the right, at its own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which event you will cooperate with Dewey's Pizza in asserting any available defenses.
12. Governing Law and Jurisdiction
These Terms of Service and any dispute, claim, or controversy arising out of or relating to these Terms or your use of the Site and services shall be governed by and construed in accordance with the laws of the United States of America and the applicable laws of the state in which Dewey's Pizza is registered and operates, without regard to any conflict of law principles that would require the application of the law of another jurisdiction.
These Terms are also subject to applicable federal laws, including but not limited to:
- The Federal Trade Commission Act (FTC Act), 15 U.S.C. § 41 et seq., governing unfair or deceptive acts or practices in commerce;

- The CAN-SPAM Act, 15 U.S.C. § 7701 et seq., governing electronic commercial communications;
- The Digital Millennium Copyright Act (DMCA), 17 U.S.C. § 512, governing online copyright matters.

You irrevocably consent to the exclusive jurisdiction and venue of the state and federal courts located in the United States for the resolution of any disputes not subject to arbitration under these Terms. You waive any objection to the exercise of personal jurisdiction over you by such courts.
13. Dispute Resolution and Arbitration
13.1 Informal Resolution
Before initiating any formal legal proceeding, you agree to attempt to resolve any dispute, claim, or controversy arising out of or relating to these Terms or our services informally by contacting Dewey's Pizza at [email protected]. We will make good faith efforts to resolve your concern within thirty (30) days of receipt. If we are unable to resolve the dispute informally within that period, either party may proceed to binding arbitration as described below.
13.2 Binding Arbitration
Except for disputes that qualify for small claims court and except as otherwise provided herein, any dispute, claim, or controversy arising out of or relating to these Terms, including the formation, interpretation, breach, or termination thereof, shall be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) in accordance with its Consumer Arbitration Rules, which are incorporated herein by reference. The arbitration shall be conducted in the English language.
The arbitrator shall have authority to award any relief that would be available in a court of law. The arbitrator's decision shall be final and binding. Judgment on the award rendered by the arbitrator may be entered in any court having jurisdiction thereof.

You have the right to opt out of binding arbitration within thirty (30) days of first agreeing to these Terms by sending a written notice of your decision to opt out to [email protected] with the subject line "Arbitration Opt-Out." If you opt out of arbitration, you agree to resolve disputes exclusively in the state or federal courts located in the United States.
14. Third-Party Links and Services
Our Site may contain links to third-party websites, applications, or services that are not owned or controlled by Dewey's Pizza. We provide these links solely for your convenience and information. We have no control over the content, privacy policies, or practices of any third-party websites or services and assume no responsibility for them.
Your use of any third-party website or service is governed by the terms and privacy policies of that third party. We strongly encourage you to review the terms and privacy policies of any third-party sites you visit. Dewey's Pizza shall not be liable for any damages or losses caused by your use of or reliance on any third-party website, content, product, or service.
15. Food Safety and Allergen Notice
Dewey's Pizza is committed to food safety and quality. However, we cannot guarantee that our products are completely free from allergens, as our kitchen environment involves the handling of common allergens including but not limited to wheat, gluten, dairy, eggs, nuts, soy, and shellfish.

20. Entire Agreement

No waiver of any term or condition of these Terms shall be deemed a further or continuing waiver of such term or condition, and any failure by Dewey's Pizza to assert any right or provision under these Terms shall not constitute a waiver of such right or provision.
21. Force Majeure
Dewey's Pizza shall not be liable for any failure or delay in performance of its obligations under these Terms where such failure or delay is caused by circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, fire, flood, pandemic, epidemic, governmental restrictions, labor disputes, internet outages, or any other events outside our reasonable control. In such circumstances, our obligations will be suspended for the duration of the force majeure event, and we will make reasonable efforts to resume normal operations as quickly as practicable.
22. No Waiver
The failure of Dewey's Pizza to enforce any right or provision of these Terms shall not be deemed a waiver of such right or provision. No waiver by Dewey's Pizza of any breach or default shall be deemed a waiver of any subsequent breach or default. Any waiver must be expressly stated in writing and signed by an authorized representative of Dewey's Pizza to be effective.
23. Assignment
You may not assign, transfer, delegate, or sublicense any of your rights or obligations under these Terms without the prior written consent of Dewey's Pizza. Any attempted assignment without such consent shall be null and void.
